STATE OF MINNESOTA <br />DEPARTMENT OF NATURAL RESOURCES <br />In the matter of the alteration of <br />the cross section of Lake Minnetonka (27-133), <br />by Gayle Wittig, without a permit from <br />the Commissioner of Natural Resources <br />FINDINGS OF FACT <br />ORDER <br />VIHEREAS, it has been brought to the Commissioner's attention <br />that certain excavation activities have been conducted in relation <br />to Lake Minnetonka (27-133), Lots 8-12, Lydiards Park, SEl/4, <br />Section 8, Township 117 North, Range 23 West, Hennepin County, <br />WHEREAS, the Commissioner has conducted an investigation of <br />this activity, <br />NOW, THEREFORE, the Commissioner issues the following Findings <br />of Fact and Order pursuant to Minnesota Statutes 103G.251. <br />FINDINGS OF FACT <br />I <br />' c <br />th <br />r <br />s <br />1. Lake Minnetonka is a public water of the State of Minnesota as <br />defined in Minnesota Statutes 103G.005, Subdivision 15 and has <br />been classified as a public water pursuant to the inventory <br />process in Minnesota statutes 103G.201, Subdivision 1. <br />■2. The jurisdictional boundary of Lake Minnetonka (27-133) is <br />defined as the Ordinaury High Water Level (OHW) by Minnesota <br />Statutes 103G.005, Subdivision 14. The OHW of Lake Minnetonka <br />is 929.4' (NGVD, 1929), as ordered by the Commissioner January <br />24, 197tf. <br />3. Gayle Wittig, Gayles Marina Corporation, 3366 North Shore <br />Drive, Wayzata, Minnesota 55391, is the owner of Lots 3-13,
