It was moved by Manager Miller, seconded by Manger <br />Love, that Mr. Jones be instructed to contact the Board of Water <br />and Soil Resources and express the desire of the District to serve <br />as the enforcement authority the Wetland Protection Act. <br />Manager Lindley agreed that the District should seek such <br />designation, but noted that this may be a contentious issue with <br />other political jurisdictions and that it has the potential to be <br />expensive for the District to regulate. Upon vote, the motion <br />carried unanimously. <br />6. Mr. Quanbeck indicated that the annual convention of the <br />Minnesota Association of Watershed Districts ("MAWD ) will be held <br />in December. However, there is some question about the ability of <br />the District to participate at the meeting since the District has <br />not paid its annual membership fees to the Association to date. <br />In the past, these fees have been forgiven by MAWD in recognition <br />of the expense being incurred by the MCWD in pursuing litigation. <br />It was moved by Manager Miller, seconded by Manager Love, that the <br />annual MAWD dues be paid and that President Spensley be authorized <br />to represent the District at the annual MAWD meeting. Upon vote, <br />the motion carried unanimously. <br />President Spensley indicated that the Coon Creek <br />Watershed District has authored a resolution that supports the <br />provisions of the watershed legislation which Senator Flynn has <br />authored on our behalf and that he expected this resolution to be <br />considered at the MAWD convention. <br />7. Mr. Quanbeck reported that the Minneapolis Park and <br />Recreation Board has raised concerns in regard to the I-35W <br />Environmental Impact Statement ("EIS"). Those concerns go to the <br />need for a water quality special study and the impact of potential <br />run-off into Legion Lake created by the proposed construction. <br />Mr. Jeff Lee, Park Board staff, was present to discuss this <br />matter. It was moved by Manager Lindley, seconded by Manager <br />Erickson, that the Board support the Minneapolis Park and <br />Recreation Board in its effort to clarify the water quality issues <br />and that the Board independently notify the Department of <br />Transportation of the Board’s concerns regarding this project. <br />Upon vote, the motion carried unanimously. <br />Attorney’s Report <br />Mr. Jones distributed a memorandum which indicated that the <br />Internal Revenue Service has been in contact with certain <br />watershed districts and believes that tax should be withheld from <br />per diem checks issued to Managers. Mr. Jones indicated that he <br />expected this to be a matter of some discussion at the MAWD annual <br />meeting, and that it is an issue which the District should <br />continue to follow. <br />ir4 MiiwtM -11-<11/21/91)
