I <br />RESOLUTION NO. `601 <br />RESOLUTION DENYING MR. JOHN MORRISON'S REQUEST <br />FOR $2,500 PAYMENT FROM THE CITY OF ORONO, FOR <br />THE REMOVAL OF TREES FROM THE COUNTY RIGHT-OF- <br />WAY IN FRONT OF MR. MORRISON'S HOUSE AS PART <br />OF THE SANITARY SEWER PROJECT 73-1. <br />WHEREAS, as part of the.Sanitary Sewer Project 73-1, <br />the city was required to remove certain trees on the county <br />right-of-way in front of Mr. Morrison's home in Orono, and <br />WHEREAS, no trees were removed from Mr. Morrison's <br />property, and <br />WHEREAS, no damages to Mr. Morrison's property were <br />sustained by Mr. Morrison, and <br />WHEREAS, no agreement had ever been made by the City <br />Council or by any of the city's staff or agents to pay Mr. ' <br />Morrison $2,500 for any purpose, and <br />WHEREAS, the city did remove Mr. Morrison's fence off <br />of public property and reconstructed it on Mr. Morrison's <br />property at his direction, and <br />WHEREAS, Mr. Morrison granted the city.a'right of <br />entry to cross his property if necessary in the construction <br />of the sewer line on the public property, <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF ORONO, MINNESOTA: <br />1. The City of Orono may not use public funds to pay <br />a private person for the removal of trees from public property <br />since to do so would constitute an illegal act by the city since <br />such payment would constitute the expenditure of .public funds <br />for private purposes. <br />2. This resolution formally sets forth the findings made <br />by the City Council at its meeting of May 13, 1975. <br />• <br />
