Item No.: 5 Date: February 26, 2024 <br />Presenter: Adam Edwards <br />Presenter: City Administrator / Engineer <br />Section:Consent Agenda <br /> <br /> <br />Title: City Code Update - Adopt Ordinance 296 <br /> <br />1.Purpose: <br />The purpose of this item is to approve changes proposed for Title III, Chapter 18 Streets and Parks <br />as part of the recodification project. <br />2.Background: <br />Recodification is a process that includes a full legal and thorough review of the city’s municipal <br />code that helps ensure that provisions are comprehensive, lawful and enforceable. In addition, it is <br />recommended that a legal review be conducted every 10-15 years for municipal codes to address <br />the needs of the city's stakeholders. The City Code was last republished in 2003. In 2022, the city <br />initiated a project to recodify the City Code. Municode, the city’s code publication vendor, <br />completed an initial chapter by chapter review. Orono staff took that review and has over the past <br />18 months have been reviewing chapter by chapter of the city code for updates. Staff reviews were <br />then followed by review by the City Attorney. <br />3.Summary: <br />The following summarizes the proposed updates. The complete list of changes is at Exhibit A. <br /> <br /> Section Updates / Proposed Changes <br />18-1 Definitions <br />- Moved some driveway definitions to Section 78. <br />- Added a series of definitions that are pertinent to the section. <br />- Amended the ROW definition to align withe State Statue <br />18-2 Obstruction - Simplified Language <br />18-3 Visibility Triangle <br />Added this section. transportation safety best practice. Included <br />figure. <br />18-6 Roadway Tampering Renamed. <br />18-9 Encroachment in Public Easements Added section to reflect the city process. <br />8-10 Public ROW vacation Added section to reflect best practice. <br />18-77 to 80 Removed. Duplicated in Article IV <br />18-106 to 111 Removed.
