NISKA, d single p^irsor., is the ov<r.t:r cf <br />a parcel of real estate located in Hennepin County, Minnesota, <br />herein after described as Tract A and legally described as <br />follows: <br />Lot 24* Also that part of Lot 14 in Wiley's Navarre Addi* <br />tion, Lake Minnetonka described as follows: Beginning at <br />the Northwest corner of said Lot 14; thence Southeasterly 25 <br />feet along the Northerly line of said Lot 14; thence South­ <br />westerly to a point in the Southwestern boundary line of <br />said Lot 14 distant 20 feet along said Southwestern line <br />from the Southwest corner of said Lot 14; thence Northwest­ <br />erly along said line to the Southwest corner of said lot 14; <br />thence Northeasterly along the Northwesterly line of said <br />Lot 14 to the poi’ of beginning; and <br />WHEREAS, PHYLLIS HENDERSON* a single person, is the fee <br />owner of a parcel of real estate presently being sold on a <br />Contract for Dead to Patrick Brickley, said parcel of real estate <br />being located in Hennepin County, Minnesota, hereinaftei referred <br />to as Tract B and legally described as follows: <br />That part of Lot 14 in Wiley's Navarre Addition, Lake <br />Minnetonka, according to the recorded plat thereof, de­ <br />scribed as follows: Commencing at the most easterly corner <br />of said Lot 14, thence southwesterly to the most southerly <br />corner thereof; thence northwesterly along the southwesterly <br />line of said lot to a point 20 feet southeasterly from the <br />most westerly corner of said lot; thence northeasterly to a <br />point on the northeasterly line thereof distant 25 feet <br />southeasterly from the most northerly corner of said lot; <br />and thence southeasterly to the point of beginning; accord­ <br />ing to the map or plat thereof on file or of record In the <br />office of the Register of Deeds in an<^. for said county and <br />state; and <br />WHEREAS, it has now been discovered that the Niska house as <br />eonrained on Tract A encroaches on Tract B; and <br />WHEREAS, it is the intention of the parties hereto to <br />establish an easement for said house on a portion cf Tract E as <br />contained herein;
