25 <br />9543.3000 PURPOSE. <br />The purpose of parts 9543.3000 to 9543.3090 is to establish <br />procedurer and standards for background studies of individuals <br />affiliated with programs subject to licensure under Minnesota <br />Statutes, chapter 245A. to protect the health, safety, and <br />rights of persons served by those programs. Parts 9543.3000 to <br />9543.3090 are not intended to govern personnel decisions of <br />employers except that personnel decisions may be affected if an <br />individual has a disqualification under part 9543.3070. <br />9543.3010 APPLICABILITY. <br />Parts 9543.3000 to 9543.3090 apply to all residential and <br />nonresidential programs subject to licensure under Minnesota <br />Statutes, chapter 245A, except child foster care, adult foster <br />care, and family day care programs. Parts 9543.3070 and <br />9543.3080 apply to child foster care, adult foster care, and <br />family day care programs. <br />9543.3020 DEFINITIONS. <br />Subpart 1. Scope. As used in parts 9543.3000 to <br />9543.3090, the following terms have the meanings given them in <br />this part. <br />Subp. 2. Background study. "Background study" means the <br />investigation conducted by the commissioner to determine whether <br />a subject is disqualified from direct contact with persons <br />served by a program. <br />Subp. 3. Commissioner. "Commissioner" has the meaning <br />given in Minnesota Statutes, section 245A.02, subdivision 5. <br />Subp. 4. Contractor. "Contractor” means any person, <br />regardless of employer, who is providing program services for <br />hire under the control of the provider. <br />iubp. 5. County agency. "County agency" has the meaning <br />given in Minnesota Statutes, section 245A.02, subdivision 6. <br />Subp. 6. Direct contact. "Direct contact" has the meaning <br />given in Minnesota Statutes, section 245A.04, subdivision 3, <br />paragraph (a). <br />Siibp. 7. License. "License" has the meaning given in <br />Minnesota statutes, section 245A.02, subdivision 8. <br />Subp. 8. Program. "Program" means a residential or <br />nonresidential program licensed under Minnesota Statutes, <br />chapter 245A.
