REGULAR CRONO COUNCIL MEETING <br />HELD MARCH 22, 1993 <br />CITY ATTORNEY’S REPORT <br />Staunton explained as part of the deal to purchase the City land, <br />the seller was required to place $75,000 In escrow to cover any <br />lawsuit Involving the property ownership rights. A lawsuit was <br />filed contesting the sellers right to sell to the CItv, the <br />District Court ruled against the other party and the Court of <br />Appeals affirmed that ruling. Since that time ail appeal time has <br />lapsed, and therefore the litigation for which the escrow was <br />established has come to a conclusion. He reported It Is his <br />recommendation to authorize the release of the escrow account. This <br />release does not affect any of the normal warranties. The City also <br />has title Insurance. Mayor Callahan has requested a summary opinion <br />:ndlcating their opinion. <br />Mayor Callahan reiterated that they won the lawsuit, and are asked <br />to release the escrow amount to the seller. <br />It was moved by Jabbour, seconded by Goetten, to release the escrow <br />account of $75,000 to the former owner of the property.
