2. The existing wall shows signs of failure. <br /> c) A wall within a defined bluff and bluff setback; and/or a replacement wall 4 feet <br /> in height or greater; and/or any new walls shall require a conditional use permit. <br /> New walls and replacement walls greater than 4 feet in height must meet the <br /> following conditions. The wall must be: <br /> 1. Designed to correct an established erosion problem; and <br /> 2. Suitable given the demonstrated need; and <br /> 3. Designed by a registered engineer or landscape architect, depending on <br /> project scope; and <br /> 4. Designed to be the minimum size necessary to control the erosion <br /> problem. <br /> SECTION 4. EFFECTIVE DATE: This ordinance shall take effect January 1, 2024 <br /> upon its passage and publication. <br /> ADOPTED this 13 day of MN ,2023 on a vote of ayes and nays by the <br /> City Council of Orono,Minnesota. <br /> ATTEST: <br /> Christine Lus >City Clerk Dennis Walsh, Mayor <br /> Ordinance published in The Laker and The Pioneer newspapers the week of , 2023. <br /> 2 <br />
