ORDINANCE NO.a5O, THIRD SERIES <br /> CITY OF ORONO <br /> HENNEPIN COUNTY, MINNESOTA <br /> AN ORDINANCE ADDING SECTIONS 78-131 <br /> RELATED TO VARIANCE AMENDMENTS <br /> THE CITY COUNCIL OF ORONO ORDAINS: <br /> SECTION 1. Orono Municipal Code Section 78-131 is hereby added with the following <br /> language: <br /> Sec. 78-131 —Variance Amendments. <br /> A proposed change to an existing variance shall be processed as either a minor amendment or <br /> major amendment as defined in this section as determined by the Zoning Administrator. <br /> a. All documents affected by the approved amendment shall be amended and replaced in <br /> their entirety. However an approved minor amendment will not modify the original <br /> issuance date of the existing variance for all purposes including Extensions under Sec. <br /> 78-129 and Expiration under Sec. 78-128 of this Chapter. <br /> b. Minor amendments. <br /> 1. Proposed amendments to variances involving twenty (20)percent or less of the <br /> total existing variance or the proposed amendment is reasonably believed by the <br /> Zoning Administrator to not be materially different than the underlying variance <br /> are minor amendments. Minor amendments may be heard by the city council <br /> without a public hearing and without planning commission consideration. <br /> 2. The Zoning Administrator may determine that a proposed amendment is a major <br /> amendment, even if it meets the criteria of a minor amendment, and shall follow <br /> the procedure for major amendments. <br /> c. Major amendments. A major amendment to the variance shall be processed and approved <br /> in the same manner as if it were a new variance request except that submission <br /> requirements shall be modified as appropriate by city staff to reflect the nature of the <br /> proposed amendment. <br /> d. Major amendments shall include: <br /> 1. Any amendment that is not a minor amendment. <br /> 2. Any amendment determined to be a major amendment by the Zoning <br /> Administrator. <br /> SECTION 2. EFFECTIVE DATE: This ordinance shall take effect immediately upon its <br /> passage and publication. <br /> 210896v1 <br />
