(2) The City Administrator or designee shall review the final plat application for conformity with <br /> chapter 78 and this chapter and with the conditions and requirements of the preliminary plat <br /> approval, and shall certify their status to the council. <br /> (3) The city attorney shall review the record plat drawing, metes and bounds descriptions, <br /> easements, deeds, covenants, agreements and other documents for proper legal form, proper <br /> representation and complete execution by all required parties, all to uphold the interests of the <br /> city, and shall certify the approval to the council. <br /> (4) The city engineer shall: <br /> a. Review the record plat drawing,metes and bounds description,easements,deeds,agreements <br /> and other documents for proper and complete legal property descriptions; <br /> b. Review and approve all construction plans; <br /> c. Approve all construction estimates for work required to be completed after final plat <br /> approval; <br /> d. Issue, when completed, certificates of satisfactory completion for all work required to be <br /> completed prior to final plat approval; and <br /> e. Certify the approval and/or status of the above to the council. <br /> (5) The city finance director shall review all final plat applications as to tax status of the property; <br /> the original, outstanding and proposed special assessment amounts levied; and the payment and <br /> status of all fees or charges imposed on the property; shall prepare all special assessment <br /> reapportionments; and shall certify the above to the council. <br /> (6) Additional comments by other city staff personnel shall be submitted in writing to the City <br /> Administrator or designee for inclusion in the record. <br /> (c) Requirements of other agencies. The subdivider shall submit to the city all written confirmation of <br /> official action taken by governmental agencies or jurisdictions subsequent to the approval of the <br /> preliminary plat. Such confirmation, including all necessary permits or authorizations, shall be <br /> submitted at the meeting at which the council will act on the final plat. <br /> (d) Final plat resolution. After review and certification of the final plat application, the City <br /> Administrator or designee,shall prepare a resolution of final plat approval or denial to be presented to <br /> the council. <br /> Sec. 82-144.- Council review of the final plat. <br /> (a) Powers. The council is the platting authority pursuant to Minn. Stat. §462.358,shall modify,approve <br /> or deny all final plat applications. <br /> Sec. 82-145.-Effective period of final plat approval. <br /> (a) The intent of the plat approval process is that final approval will be granted only upon satisfactory <br /> completion of all requirements by the subdivider, in which case plat certification and recording will <br /> follow without delay. The Final Plat shall be recorded within 1 year of approval date. <br /> (b) Failure of the subdivider to complete any or all requirements within this time period shall constitute <br /> a formal withdrawal of the proposed plat. <br /> Secs. 82-146-82-171.-Reserved. <br /> Final Draft page 18 <br />
