If the city fails to certify final approval as so required, and if the applicant has complied <br /> with all conditions and requirements, the application shall be deemed finally approved; and upon <br /> demand the city shall execute a certificate to that effect. After final approval, a plat may be filed or <br /> recorded. <br /> (e) Grading of site prior to final approval. Subsequent to preliminary plat approval by the council, the <br /> subdivider may apply for a land alteration permit from the city and upon receipt of such permit may <br /> commence construction to the grades and elevations required by plans approved by the city. <br /> Sec. 82-116.-Effective period of preliminary plat review. <br /> Council resolution concerning any preliminary plat shall remain effective for one year. Failure to file <br /> a complete final plat application within this time period shall be construed as formal withdrawal of the <br /> proposed plat. <br /> Secs. 82-117-82-140.-Reserved. <br /> DIVISION 3. -FINAL PLATS <br /> Sec. 82-141.- Generally. <br /> (a) Purpose. Final plat review is the final stage of the plat review process.The legal documents,including <br /> plat drawings, are reviewed for completeness and conformity with the intent and requirements of the <br /> preliminary plat approval. <br /> (b) Requirements. The applicant is required to furnish completed surveying, engineering, and legal <br /> documents suitable for recording in the county recorder's office, incorporating all the information <br /> and/or changes required as part of the preliminary plat review and resolution of preliminary plat <br /> approval.All documents and requirements shall be completed by the subdivider, reviewed by the city <br /> staff and the council, and approved by the council prior to the mayor's and city clerk's certifying <br /> approval of the final plat. <br /> (c) Prerequisite. A preliminary plat of substantially the same proposal shall have been approved by the <br /> council within one year of the filing of any final plat application. The City Administrator or designee <br /> shall review each final plat application to ensure substantial conformity to the requirements and <br /> representations on the preliminary plat. <br /> (d) Substantial change from preliminary plat. The council may refuse to approve any final plat <br /> application which is substantially different from the approved preliminary plat, or which discloses <br /> possible misrepresentations on the preliminary plat. In the case of such denial council may require the <br /> applicant to resubmit the proposal for planning commission reconsideration, and may require the <br /> applicant to submit or resubmit any and all documents or information required for preliminary plat <br /> review. Planning commission reconsideration may include a new public hearing. The applicant shall <br /> pay applicable preliminary plat review fees. <br /> Sec. 82-142.-Final plat application. <br /> (a) All plats.
