ORDINANCE NO. 153, THIRD SERIES <br />CITY OF ORONO <br />HENNEPIN COUNTY, MINNESOTA <br />AN ORDINANCE AMENDING THE ORONO MUNICIPAL CODE <br />BY AMENDING SECTIONS 82-117,78-128,78-149, and 78-918 <br />REGARDING THE NUMBER OF EXTENSIONS ASSOCIATED WITH APPROVED <br />PROJECTS. <br />THE CITY COUNCIL OF ORONO ORDAINS: <br />SECTION 1. Section 82-117 of the City of Orono Municipal Code is hereby amended by <br />adding and deleting text as follows: <br />Sec. 82-117. - Effective period of preliminary subdivision review. <br />Planning commission recommendations concerning any class I subdivision and the council resolution <br />concerning any class II and class III preliminary plat shall remain effective for one year. Failure to file a <br />complete final subdivision application within this time period shall be construed as formal withdrawal of <br />the proposed subdivision. <br />For one year following preliminary approval, unless the subdivider and the city agree otherwise, no <br />amendment to a comprehensive plan or official control shall apply to or affect the use, development <br />density, lot size, lot layout, or dedication or platting required or permitted by the approved application. <br />Thereafter, pursuant to its regulations, the city may extend the approval period by agreement with the <br />subdivider and subject to all applicable performance conditions and requirements, or it may require <br />submission of a new application. In no case shall the approval period be extended greater than three <br />years. <br />SECTION 2. Section 78-128 of the City of Orono Municipal Code is hereby amended by <br />adding and deleting text as follows: <br />Variances shall expire one year after the date of council approval if not used and an extension has not <br />been granted. Any change in use of the property shall require a new variance. In no case shall more than <br />three, one year extensions be granted. <br />SECTION 3. Section 78-149 of the City of Orono Municipal Code is hereby amended by <br />adding and deleting text as follows: <br />Sec. 78-149. - Lapse of approval. <br />Unless otherwise specified by the city council or the planning and zoning coordinator, a site plan <br />review approval shall become null and void one year after the date of approval, unless the property owner <br />or applicant has substantially started the construction of any building, structure, addition or alteration, or <br />Page 1 of 2 <br />
