ORDINANCE NO. 135, THIRD SERIES <br />CITY OF ORONO <br />HENNEPIN COUNTY, MINNESOTA <br />AN ORDINANCE FOR PROTECTING THE CITY'S WELLHEADS BY PROHIBITING <br />NEW PRIVATE WELLS WHERE PUBLIC WATER SUPPLY IS AVAILABLE <br />THE CITY COUNCIL OF ORONO ORDAINS: <br />SECTION 1. Orono Municipal Code Section 14.142 regarding Wellhead Protection <br />New Private Wells Prohibited is hereby adopted to read as follows: <br />Sec. 14-142.- Wellhead Protection - New Private Wells Prohibited. <br />(a) -The owners of all buildings where a public water supply is available, or becomes <br />available, shall connect the buildings to the public water supply, subject to the following <br />conditions: <br />(1) A private property with a functioning well will not be required to be connected to the <br />city water until the well becomes nonfunctioning or the building undergoes major remodeling <br />resulting in an increase in water use that exceeds the capacity of the well. <br />(2) Where it is not feasible to connect to a public water supply, or if private on-site <br />water supplementation is required as determined by the City of Orono, a well may be drilled in <br />accordance with the specifications and provisions of the Minnesota Department of Health, Water <br />Well Construction Code. <br />(b) At the time connection to the public water supply is completed, all existing private wells <br />no longer in use shall be sealed by a licensed well contractor according to the Rules of the Minnesota <br />Department of Health. <br />SECTION 2.
