ORDINANCE NO. 46,THIRD SERIES <br /> AN ORDINANCE AMENDING THE MUNICIPAL CODE OF ORONO <br /> AND AMENDING THE OFFICIAL ZONING MAP <br /> BY REZONING PORTIONS OF PROPERTIES WITHIN THE BLOCK BOUNDED BY <br /> SHADYWOOD ROAD, SHORELINE DRIVE, KELLY AVENUE <br /> AND LYDIARD AVENUE <br /> FILE #08-3368 <br /> WHEREAS, the City of Orono is a municipal corporation organized and existing <br /> under the laws of the State of Minnesota; and <br /> WHEREAS,within the block bounded by Shadywood Road,Shoreline Drive,Kelly <br /> Avenue and Lydiard Avenue in the City of Orono zoning district lines do not follow property lines, <br /> causing six properties to have two zonings; and <br /> WHEREAS,none of these six properties with two zonings could be subdivided into <br /> conforming lots along the zoning district boundaries; and <br /> WHEREAS, the Orono Planning Commission initiated a rezoning so each parcel <br /> would have only one zoning; and <br /> WHEREAS, after due published notice and mailed notice in accordance with <br /> Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning <br /> Commission held a public hearing on June 16,2008 at which times all persons desiring to be heard <br /> concerning the rezoning were given the opportunity to speak thereon; and <br /> WHEREAS,on June 16,2008,the Orono Planning Commission by a vote of 5 to 0 <br /> recommended approval of the rezoning. <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ORONO <br /> DOES HEREBY ORDAIN: <br /> Section 1. The Municipal Code of Orono is amended by amending the official zoning map and <br /> zoning district boundaries for the properties described as follows: <br /> Tract C, R.L.S. No. 88 and Lot 2, Block 1, Orono Hills, all in Hennepin County, <br /> Minnesota <br /> Said properties are hereby rezoned from LR-1B One family lakeshore residential and B-4 Office and <br /> professional business district to LR-1B One family lakeshore residential. <br /> Page 1 of 3 <br />
