� r <br /> � � <br /> � ORDINANCE NO 18 , THIRD SERIES <br /> AN ORDINANCE AMENDING THE CITY OF ORONO <br /> ZONING CODE SECTION 78-1 AND <br /> SECTIONS 78-230 (A), 255 (A), 305 (A), 330 (A), 350 (A),370 (A), 395 (A), 420 (A), <br /> 44 (A), 502, 572, 646 (I), 672 (A), 707 (N), 736 (I), 766 (I), 797 (7), 825 (D) <br /> REGARDING BUILDING HEIGHT <br /> The City Council of Orono ordains as follows: <br /> Section 1: Municipal Zoning Code Section 78-1 regarding the definition of building <br /> height is hereby revised as follows: <br /> Sec. 78-1. Definitions. <br /> Building height means the vertical distance between the highest adjoining ground <br /> level at the building or ten feet above the lowest ground level, whichever is lower, and <br /> the top of the cornice of a flat roof, or the deck line of a mansard roof, or the uppermost <br /> point on a round or other arch-type roof, or the a�te�ge median height of the highest <br /> gable of a pitched or hipped roof. Topographic changes which elevate the adjoining <br /> ground level above the existing teiTain shall not be considered in determining building <br /> height. For a pitched or hipped roof situation regardless whether the hi�hest livin� space <br /> in a buildin� is a half-storv or full storv if the hi��hest livin� space contains windows <br /> (excludin� skvlightsl the upper measurin� point for definin� buildin� hei�ht shall be the <br /> median hei�ht of the top of the hi�hest window and the hi�hest peak of the roof. <br /> Section 2: Municipal Zoning Code Section 78-1 is hereby revised to include the <br /> following definition: ' <br /> Sec. 78-1. Definitions. <br /> Half story means the u�permost floor of a buildin� in which (i) the intersection of <br /> the exterior wall and the roof is not more than three (31 feet above the floor elevation, and <br /> �ii) not more than 60 percent of the floor area within the exterior walls of the uppermost <br /> floor exceeds five (5) feet in hei�ht as measured from the floor to the rafters. Floors <br /> exceedin�these parameters shall be deemed a full storv. <br /> Section 3: Municipal Zoning Code Sections 78-78-230 (A), 255 (A), 305 (A), 330 <br /> (A), 350 (A), 370 (A), 395 (A), 420 (A), 44 (A), 502, 572, 646 (I), 672 (A), 707 (N), 736 <br /> (I), 766 (I), 797 (7), 825 (D) regaxding the building height requirement are hereby revised <br /> as follows: <br /> Sec. 78-230. Area,height, lot width and yard requirements. <br /> (a) Height. No structure or building in the R-lA district shall exceed 2'/2 stories <br /> e�and shall not exceed 30 feet in height except as provided in section 78-1366. <br />
