ORDINANCE N0. 16, THIRD SERIES <br /> AN ORDINANCE AMENDING CHAPTER 78 OF <br /> THE ORONO MUNICIPAL CODE BY <br /> DELETING SECTIONS 78-1100 THROUGH 78-1176 <br /> AND BY ADDING NEW SECTIONS 78-1100 THROUGH 78-1140, <br /> REGARDING FLOODPLAIN MANAGEMENT <br /> The City Council of Orono ordains as follows: <br /> SECTION 1: Municipal Zoning Code Chapter 78, Zoning Regulations, Article VIII, <br /> Floodplain and Wetlands Management is hereby amended by repealing the Article title <br /> and division headings, and Sections 78-1100 through 78-1176, in their entirety. <br /> SECTION 2: Municipal Zoning Code Chapter 78, Zoning Regulations, Article VIII is <br /> further amended by adding a new Article title, division headings and Sections 78-1100 <br /> through 78-1140 which are summarized as follows: <br /> "ARTICLE VIII. <br /> FLOODPLAIN MANAGEMENT <br /> DNISION 1. STATUTORY AUTHORIZATION,FINDINGS OF FACT AND PURPOSE <br /> Sec.78-1101 Statutory Authorization. <br /> The legislature of the State of Minnesota has, in Minnesota Statutes Chapter 103F and <br /> • Minnesota State Statute 462.357 delegated the responsibility to local government units to adopt <br /> regulations designed to minimize flood losses. Therefore,the City Council of the City of Orono, <br /> Minnesota does ordain as follows: <br /> Sec.7&1102 Findings of Fact <br /> (a) The flood hazard areas of the City of Orono,Minnesota,are subject to periodic <br /> inundation which results in potential loss of life,loss of property,health and safety hazards, <br /> disruption of commerce and governmental services,extraordinary public expenditures for flood <br /> protection and relief, and impairment of the tax base,all of which adversely affect the public <br /> health, safety, and general welfare. <br /> (b) Methods Used to Analyze Flood Hazards. This Ordinance is based upon a <br /> reasonable method of analyzing flood hazards which is consistent with the standards established <br /> by the Minnesota Department of Natural Resources. <br /> (c) National Flood Insurance Pro�am Compliance. This Ordinance is adopted to <br /> comply with the rules and regulations of the National Flood Insurance Program codified as 44 <br /> Code of Federal Regulations Parts 59-78, as amended, so as to maintain the community's <br /> eligibility in the National Flood Insurance Program. <br /> Page 1 of 24 <br />
