L’Allier, 2684 Lydiard Avenue <br />Conditional Use Permit - Resolution <br />Brief Review of Application and Planning Commission Recommendation <br />A building pennit has been issued for the major renovation of the principal structure and <br />the second floor addition of living quarters over the garage area connected by a 5’ wide skyway, <br />review Exhibit J. The current building permit was issued for living quarters without a kitchen <br />area. A conditional use permit is required as applicants wish to install a kitchen/eaiing area <br />within the second floor living quarters providing an independent residential unit for applicant’s <br />parents. <br />As in the recent Waade application, internal access to the apartment area as proposed <br />does not appear to meet the true intent of the conditional use permit for guest apartment. Access <br />to the apartment area could be via a second floor open exercise area in principal structure, <br />internal stair within garage or exterior stair at rear deck/three-season porch (review Exhibits G, <br />I and K). <br />The Planning Commission recommended approval of the conditional use permit subject <br />to the permit being issued to the current owner and that future owners would be required to <br />either apply for a conditional use permit for continued non-rental guest apartment use or building <br />permit for removal of kitchen area. The Planning Commission further conditioned approval on <br />the tear access stair from three season porch being removed. It is staff s recommendation that <br />the rear access stair be allowed to remain for safety purposes as the only access from the second <br />story *.iving quarters would be either through the limited 5* skyway link or through the internal <br />stair within the garage. If a fire is to occur, it is more than likely to occur in the garage area <br />limiting access via the skyway. If the appropriate controls are developed for the use of the <br />apartment area, it would appear not necessary' to require the removal of the secondary safety <br />access. <br />The enclo.sed approval resolution has been drafted per the Planning Commission <br />iCCominendaMon but can be altered it Council agrees to allow the exterior stair at rear of garage. <br />Isv
