ORDINANCE #SECOND SERIES <br />AN ORDINANCE AMENDING SECTION 5.24 ADOPTED APRIL 1, 1984 AND <br />AMENDED iv vRCK 25, 1990 AND ENTITLED "TOBACCO." <br />The City Council of Orono ordains: <br />Section 5.24, Tobacco is hereby amended by adding the <br />following language: <br />Subdivision 4. Tobacco Products: Prohibited Sales from <br />vending machines. <br />A. Tobacco products may be offered for sale in vending <br />machines licensed under this chapter only on premises which <br />possesses a current On-Sale Intoxicating Liquor license. In <br />addition to any other requirements imposed by law, there shall be <br />placed on each tobacco product vending machine a notice as follows: <br />"If you are under age 10 and purchase or attempt to purchase any <br />tobacco product from this machine, you will be subject to a <br />mandatory fine of $100." <br />B. No cigarette vending machine may be located in the <br />entrance area of the licensed premises. <br />C. Cigarette vending machines must be located at least 20 <br />feet from the entrance of the licensed premises, and must be wj* in <br />easy view of the employees or the establishment. <br />Subdivision 5. Purchase or attempted purchase of tobacco <br />products by minors prohibited. <br />A. It shall be unlawful for any person who has not attained <br />the age of 18 years of age to purchase or attempt to purchase any <br />tobacco product. A person under the age of 18 years of age who is <br />alleged to have violated this section shall be subject to the <br />jurisdiction of the Juvenile Court under Minn. Stat, Section <br />260.il!. In addition to the dispositions otherwise provided by <br />law, a violation of this section shall subject the minor to a fine <br />of $100 for a first violation or $200 for any subsequent violation. <br />This ordinance shall become effective upon publication. <br />Adopted by the Council at a regular meeting held March 8, <br />1993, by a vote of _ _ _ ayes, _ _ _ nays. <br />Edward J.
