Mabusth, Building and Zoning Administralo^^% <br />February 18, 1993 <br />%!? <br />%m#1798 Fred and Barbara Ryan, 1345 North Arm Drive - Vacation of DKlicated <br />Road - Resolution <br />Brief Review of Application <br />111 May of 1988, Ryans had originally participated in the tiling of Application #1298 that <br />sought the vacation of the remainder of Forest Blvd. Portions of Forest Blvd. had been <br />approved for vacation by the City Council in March of 1988. During the review of that <br />application, a property owner (Gordon Nelson) had advi.sed of access problems resulting from <br />an earlier vacation of Oak Place in the early '70s. His property was legally landlocked -^nd the <br />City lost access to sewer lines that remained in the Oak Place right-of-way. The application was <br />tabled by the Planning Commission until the Nelson problem and the City ’s sewer easements <br />were resolved. After the five year time lapse, the Ryans had assumed the vacation was <br />completed. Not until a title search was prepared for a potential sale of their property did they <br />realize that Forest Blvd. remained dedicated right-of-way. This issue has jeopardized the sale <br />of their property and they have been required to file a separate vacation application to complete <br />the vacation adjacent to their property. <br />Please review the enclosed staff packet for more detail on background of the former <br />application. <br />The Planning Commisnon unanimously approved the vacation for the Ryans based on <br />the findings established by the City in the original vacations of Forest Blvd. of 1988. In <br />addition, it was determined that the vacation of the portion adjacent to the Ryan property would <br />have no impact on the Nelson property. The enclosed resolution has been drafted per the <br />findings and conditions set fortli in the Planning Commission approval. <br />/ <br />i
