Il
TO;
FROM:
DATE:
Mayor and City Council ^
Ron Moorse, City Administrator
February 17, 1993
SUBJECT: Cigarette Vending Machine Ordinance
% - XV
Attachments:A. Memoranda From Past Council Actions Related to
the Cigarette Vending Mach'ne Issue
B. Memo from the Police Chief concerning Vending
Machines
The current cigarette vending machine ordinance includes a total
ban on the sale of cigarettes through vending machines. The
Council at its January 25th meeting requested staff to provide
information regarding allowing vending machines in establishments
which prohibit minors. The attached information includes an
ordinance which allows cigarette vending machines only on premises
which possess a current On-Sale intoxicating liquor license. This
language was suggested by the City Attorney as being a more
defendable way to allow vending machines in establishments where
those under 18 years of age are prohibited (unless accompanied by
at least one parent or guardian). An ordinance allowing cigrirette
vending machines in On-Sale liquor establishments would allow two
establishments in Orono to have vending machines - Jimmies Bar and
the Wayzata Country Club.
The attachments also include a February 20, 1990 memo from Dorothy
Hallin which lists a number of alternative ways to limit vending
machine sales.
The Council may at this time choose to retain the current ordinance
in which no action is required. The Council may also cnoose
to amend the current ordinance.
