Mabusth, Building & Zoning Administrator <br />DATE:February 8, 1993 <br />SUB.FECT: #1799 Albert and Sally Hanser, 1685 Fox Street - Conditional Use Permit/ <br />Variance - Public Hearing <br />Pertinent Ordinance <br />Section 10.03, Subd. 19. Applicants propose alterations in excess of 100 cubic yards. <br />Alterations will take place within approximately a 8,000 s.f, area of a 22,700 s.f. <br />drainage easement area. At its deepest point the pond will be approximately 5’3" <br />(existing elevations 933.3, proposed lowest elevation 928). <br />Variance Required for Land Alterations within Area Protected by Flowage and <br />Conservation Easement <br />As already noted in the earlier review of the 3-lot subdivision, the low woexied area was <br />not classified as a designated wetland within the City’s mapping nor is it a DNR protected <br />wetland. The area was designated as a drainage easement with the standard flowage and <br />conservation taken over the area. If applicants propose alterations within protected drainage <br />easement areas, the City must approve per the conditions of the Flowage and Conservation <br />Easement. Applicants were required to make certain storm water improvements for the MCWD <br />permit involving 1 ’ excavations for the purpose of creating a sediment trap.
