The application involves Lot 1, Block <br />1 of Wildhurst Estates, a recent subdivision approved by this City, containing 1.56 acres in area. <br />The property meets all required lot standards of the LR-IB Zoning District. <br />The issue for the review at the Planning Commission was that the primary access to the <br />1,000-b s.f. apartment area was not from within the interior of the principal residence but via <br />the unfinished garage The size of the apartment was also questioned but it was also noted that <br />there are no area limitations set fonh in the Code. The principal strucmre itself is 7,000 s.f. <br />in area and as applicant notes valued at $1,000,000.00. Review Exhibit G, applicant advises <br />that it is highly unlikely that a future owner would offer for rent an apartment in a house valued <br />at $1,000,000*00. <br />The Planning Commission unanimously approved the application and conditioned <br />approval on applicant submitting a revised plan redefining access area within the principal <br />structure meeting the intent of the ccxle (refer to Exhibit H). Access is now' located within an <br />office and with stairs leading directly to upper level apartment. The conditional use permit is <br />to be issued to the current owner and shall expire upon the sale or transfer of fee title to another <br />agent or person. It would then be the responsibility of the next owner > apply for a conditional <br />use permit if non-rental apartment use is to continue. It not, future owner will be responsible <br />for making necessary' alterations to structure so that kitchen area is removed. Please note <br />applicant has asked Council to reconsider this condition. All other standards of the conditional <br />use pennit are to be adhered to as follows: <br />1. All utilities shall be metered under the meter for the principal structure. <br />There will be no separate address provided for the .iparlment user
