f <br />4 <br />WHEREAS/ after due published and mailed notice in <br />accordance with Minnesota Statutes 462.38 et. seq. and the City of <br />Orono's Zoning and Subdivision Codes, the Orono Planning Commission <br />held a public hearing on November 16, 1992, at \.*hich time all <br />persons desiring to be heard concerning this application were given <br />the opportunity to speak thereon; and <br />WHEREAS, at their regular meeting held on December 14, <br />1992, the Orono City Council considered the subdivision application <br />of Andrew J. Goetten, noting the following findings of fact: <br />1. The portion of the property proposed for subdivision is <br />located within the RR-13 Single Family Rural Residential <br />Zoning District requiring a minimum of two ac.res of contiguous <br />dry buildable land within each newly created lot. <br />2. The property contains a total of approv:imately 3.66 <br />acres, of which 3.01 acres is contiguous dry buildable land <br />exclusive of 33 feet of right-of-way for Orono Orchard Road, <br />wetlands, and the non-contiguous portions south of County Road <br />15 . <br />3. The proposed plat contains two lots. Lot 1 consisting of <br />1.73 dry contiguous acres plus 0.23 acres located south of <br />County Road 15 for a total of 2.01 acres and Lot 2 consisting <br />of 1.23 dry contiguous acres. Lot 1 requires a variance tc <br />allow credit for non-contiguous area. Lot 2 requires a lot <br />variance. These variances have been granted per the <br />findings and conditions of Resolution No. 3223 of the City <br />Council. <br />4. Each of Lots 1 and 2 abuts a public roadway open to <br />traffic, and each lot contains the required 200' lot width <br />requirement as measured at the rear of the 50' front yard. <br />5. Lot 2, containing an existing residence, is within the <br />Metropolitan Urban Service .Area (MUSA) and is provided with <br />municipal sewer as part of the 1980-1 Minnetonka Bluffs Sewer <br />Project. Lot 1, currently vacant, will not be served with <br />municipal sewer, is outside the MUSA, and has been confirmed <br />as having acceptable primary and alternate drainfield sites. <br />Page 2 of 6
