A RESOLUTION GRANTING VARIANCES <br />TO MUNICIPAL ZONING CODE <br />SECTION 10.28, SUBDIVISION 5 (B) AND <br />SECTION 10.56, SUBDIVISION 16 (C-1) AND (L-1) <br />FILE NO. 1792 <br />WHEREAS, Donald R. Gronbe.-g (hereinafter "the applicant") is the owner of <br />the property located at 110 Leaf Street within the City of Orono and legally described as <br />follows: <br />Tract B, Registered Land Survey No. 744, Files of Registrar of Titles, County <br />of Hennepin. Minnesota (hereinafter "the property"); anr' <br />WHEREAS, the applicant has applied to the City for variances to Municipal <br />Zoning Code Sections 10.28. Subdivision 5 (B) and Section 10.56, Subdivision 16 (C-1) and (L- <br />1) to permit the construction of a residence on a property that contains 30.390 s.f. or .69 acres <br />where 87,120 s.f. or 2 acres is required, the structure shall be set 50 ’ from a protected tributary <br />where a 75 ’ setback is required. The encroachment of the 75 ’ setback area will result in 1,402 <br />s.f. or 8.65% hardcover within the 0-75 ’ setback area where no such hardcover is allowed. <br />Minnesota: <br />3. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono. <br />FCSDLNGS <br />This application was reviewed as Zoning File #1792. <br />The propeny is located in the RR-IB Rural Residential Zoning District. <br />The Orono Planning Commission reviewed this application on January 19, 1993 <br />and recommended approval of the proposed variances based upon the following <br />findings; <br />A.
