1 <br />‘”1 <br />k <br />V1 <br />TO: <br />FROM: <br />Mayor £*id City Council <br />Ron Moorse, City Administrator <br />%eOa <br />DATE:January 21, 1993 <br />SUBJECT: Ci'jarette Vending Machine Ordinance <br />At the Council's request staff has pulled together information <br />related to the City's current ordinance which prohibits the sale of <br />cigarettes from vending machines. I have attached minutes of the <br />Council meetings from early 1990 and a copy of the current <br />ordinance to provide the Council with background regarding the <br />ordinance. This ordinance is similar to ordinances adopted by <br />numerous Metro area cities in recent years. <br />The attached minutes indicate the original ordinance amendment <br />prohibited all cigarette vending machines except in those <br />establishments where minors were prohibited. This would have left <br />Jimmies bar as the only establishment to be allowed to have <br />cigarette vending machines. The amendment as finally adopted <br />provided for a total ban on vending machines. <br />The Police Department has indicated the prohibition of vending <br />machines does provide a significant barrier to the purchase of <br />cigarettes by minors. Lt. Cheswick indicated that although the <br />number of minors entering an establishment such as Jimmies would be <br />small, the requirement that cigarettes be sold from a counter does <br />provide an additional barrier to cigarette purchases by minors. <br />Lt. Cheswick suggested th^.t if the Council were to allow cigarette <br />vending machines in an establishment such Jimmies, the vending <br />machine should be required to be located a significant distance <br />from the entrance and within easy view of the bartender '■ ' ensure <br />it is supervised to prevent use by minors. <br />1 <br />A
