7. 33' of right-of-way for Orono Orchard Road will be <br />dedicated within the plat. A small triangular portion of land <br />shall similarly be dedicated as right-of-way for Orono Lane, <br />from the portion of property located south of County Road 15. <br />8. No additional right-of-way will be dedicated for Fox <br />Street. No upgrade of the existing Fox Street roadway will be <br />reguired as part of this subdivision. <br />9. Lot 2 shall continue to gain access from Fox Street. Lot <br />1 shall be allowed access either on Fox Street or Orono <br />Orchard Road (but not from both roadways) at a location to be <br />approved by the Public Works Department. <br />10. The portion of property located south of County Road 15 <br />and Orono Lane shall be platted as Out lot A, and shall be used <br />in the future for no more than one of the following three <br />uses: <br />A. Ownership in common with Lot 1 as residential lake <br />access for Lot 1. <br />B. Ownership in common with Lot 2 as residential lake <br />access for Lot 2. <br />C. For sale or transfer to one of the two neighboring <br />properties adjacent to said outlot, for legal <br />comb...nat ion. <br />Any use of Outlot A other than for one of the above three <br />purposes shall require City Council approval. <br />11. A variance is required for side setback for the existing <br />detached garage which will as a result of the newly create <br />lot line be located 2' from the side let line rather than the <br />10' side setback requirement for detached accessory <br />structures. Said structure is recognized as a non-conforming <br />structure as is an existing shed and the existing residence, <br />all such structures being located within the 50' defined front <br />yard. <br />Page 3 of 6
