RESOLUTION NO. 93-9477 <br />RESOLUTION PROVIDING COMMENTS REGARDING THE DRAFT HOINEPIN <br />COUNTY GROUND WATER PLAN <br />BE IT RESOLVED by the City Council of the City of <br />Minnetonka, Minnesota as follows: <br />Section 1. Background. <br />1.01. <br />1.02. <br />1.03. <br />1.04. <br />Minnesota statute provides permissive authority <br />to counties to develop and adopt ground water <br />protection plans. <br />Hennepin County has determined it to be <br />appropriate to prepare and adopt a ground water <br />protection plan in accordance with this <br />authority. <br />Adoption of the proposed Ground Water Plan by <br />the Hennepin County Board requires watershed <br />management organizations to prepare and adopt a <br />ground water protection component to their <br />plans. <br />Adoption by water management organizations of <br />ground water protection components to their <br />plana requires municipalities to prepare and <br />adopt ordinances and regulations implementing <br />and enforcing the requirements of the Hennepin <br />County Ground water Plan. <br />section 2. Findings. <br />2.01. <br />2.02. <br />2.03. <br />The cost of implementing and enforcing the <br />requirements of the Hennepin County Ground Water <br />Plan are to be borne by the municipalities; the <br />costs associated with protecting a state-wide <br />resource should not be the responsibility of <br />individual municipalities. <br />The proposed plan is redundant with respect to <br />ground water protection activities being <br />undertaken by the Minnesota Department of <br />Health. <br />The requirements proposed by the Hennepin Cotinty <br />Ground Water Plan are excessive with respect to <br />the Ground Water Protection Regulations now <br />being developed by the Minnesota Department of <br />Health.
