B. <br />C. <br />D. <br />The existing septic system has a three pius iK'droom capacity aiiJ will <br />easily serve the upgraded three bedroom home. <br />In April of 1978 the City approved a rear setback of 47’ for a proposed <br />12’x24 ’ rear addition to the existing residence but was never constructed. <br />The only suicable area for expansion of existing residence is to the west <br />or side. <br />m* City Council finds that the conditions existing on this property are peculiar <br />to it and dv) ivit apply generally to other property in this zoning district; that <br />granting the variance would not adversely affect traffic conditions, light, air nor <br />pose a fire hazard or other danger to neighboring property; would not merely <br />serve as a convenience to the applicant, but is necessary to alleviate a <br />demoastrable hardship or difficulty; is necessary to preserve a substantial property <br />right of the applicant; and would be in keeping with the spirit and intent of the <br />Zoning Code and Comprehensive Plan of the City. <br />The Cits Council has considered this application including the findings and <br />recommendations of the Planning Commission, reports by City staff, comments <br />by the applicant and the effect of the proposed variance on the health, safety and <br />welfare of the community. <br />(ONCI-USIONS, ORDKR AM> CONDITIONS <br />Based upon one or more of the above firelings, the Orono City Council bereby <br />grants variaiKcs to .Municipal Zoning Code Section 10.28, Subdivisions 5 (B) to permit <br />construction of a 23 x42 addition to the west side of the existing residence granting a right side <br />setback variance of 1 rb" or 38.6% and a rear setback variance of 2 ’6 ' or 5.2%. subject to the <br />following conditions: <br />I.
