Nafstad, for the vacation of the plat of Herrick Circle. ) ) ) ) NOTICE OF HEARING PETITION TO VACATE PLAT OF HERRICK CIRCLE Notice is hereby given that the petitioners as owners of all of Herrick Circle, according to the plat thereof on file and of record in the office of the Registrar of Titles in and for the County of Hennepin and State of Minnesota, will present his Petition to the District Court of the County of Hennepin aforesaid, at a special terra thereof to be held at the Court House, in said Hennepin County, on the ^th day of September, 1977, at 9:30 o'clock a.m. , or as soon thereafter as counsel can be heard, asking for an Order and Decree of said Court adjudging and declaring that all of the plat of Herrick Circle described as follows, to-wit: That part of the Northeast Quarter of the Southwest Quarter and the Southeast Quarter of the Southwest Quarter of Section 36, Township 118, Range 23, described as follows: Beginning at a point on the East line of said Southwest Quarter distant 57 feet Southerly of as measured at right angles from the center line of the tract of the Minneapolis Industrial Railway Company as now located and established; thence South along said East line to a point distant 283.23 feet South of the Northeas corner of said Southeast Quarter of the Southwest Quarter; thence South 19 degrees AO minutes West a distance of 138.06 feet; thence South 27 degrees AO minutes West to the center line of the South Minneapolis and Watertown Road, also caHed the Wayzata Long Lake Road; thence Northwesterly along said center line to its intersection with a line drawn parallel with and 57 feet Southerly of, as measured at right angles from, the center line of said main track; thence Northeasterly along said parallel line to the point of beginning. For purposes of this description the East line of said Southwest Quarter is assumed to be a due North and South line. to be annulled, and adjudging and decreeing the title to all of said land so vacated to be in your petitioner, free from all encumbrances arising from the donation and dedication of road, circle, utility and drainage easements to the public and to the City of Orono Marlais C.
