RESOLUTION VACATING THE PLAT OF HERRICK CIRCLE IN THE CITY OF ORONO WHFRFAS the Citv Council o£ the City o£ Orono has reviewed an application to replat of ?lrrick Circle including the area occupied by the Street o£ the same name; and WHEREAS, the proposed replatting Known as Summit Station has been presented to the City Council £or £inal approval; and WHEREAS, the proposed replatting h^ been determined to be consistent with the Comprehensive Guide Plan o£ the City, an MEREAS, the City of Orono finds it to be in the public interest to proceed with the replatting; and WHEREAS, the owners of all of Herrick Circle Plat have petitioned the District Court £or vacation o£ the Plat o£ Herrick Circle, an WIEREAS the proposed Summit Station Plat includes Outlot #2 owned by tl?e™ceM lot Lners and to serve as open space and as access to the lots. and WHEREAS, the City will receive an open space and underlying access easement over Outlot #2; vacation of the^^^fHe^iS ll^ubj^t^o Sr£ollowing: That the replatting of Herrick Circle Subdivision as Summit Station be approved by the City and completed by the developer. 2.That as a part of the approval of Summit Station Plat open space and underlying access easement over Outlot be dedicated to the City. 3.That the developer of Summit Station agrees to rein^urse the City for all of its costs including administrative and legil in the review and accomplishment of the vacation as part of. the subdivision requirements. 4.
