Zoning Administrator <br />August 11, 1977 <br />JeronG Carlson - 170 Smith Avenue <br />Conditional Use and Variance <br />Wetlands Variance and Setback Variance <br />The applicant is requesting permission to build a "sports court" for tennis, <br />basketball, etc. Work has already begun and a Stop Order has been posted <br />because the work appears to be in a designated wetlands and because it extends <br />over the property line. We have been told tJiat there is or was intention to <br />enclose the court at a later date. <br />Staff received a call on July 20 asking \vhat was necessary to build tlie sla . <br />When we learned of the proposed enclosure we adidsed of the need for a survey <br />and for a variance for the enclosure because the slab exceeds the maximum <br />allowable accessory building size. No further contact was made by the appli­ <br />cant until August 9, 1977, when a variance application was received including <br />a survey (Exhibit A) . Inspection by Mr. Muhich and Tom Jacobs on August 10, <br />1977, showed that forms and gravel base were already installed in a location <br />other than that indicated on the survey. There were no lot comer stakes <br />visible and the construction had apparently encroached on the designated wet­ <br />lands. A stop order was posted. <br />On August 11, 1977, the applicant submitted a revised survey (Exhibit B) dated <br />Julv 28 1977 showing the "athletic court under construction" across the east <br />property line. The applicant advised ^tr. ^tuhich that the court location was a <br />mistake discovered when the survey was made and that the current intention is <br />to relocate the court as shown on Exhibit A. <br />The zoning'code specifies a residential accessory building to be a mxirni^ <br />1 000 sq. ft. This court is 1,800 sq. ft. and would become a building if <br />enclosed.
