Planning Commission members must provide a deadline <br />for the phasing out of the second floor rental apartment currently occupied. At thf. time the <br />building is vacated by all renters, specific structural modifications vould be required, i.e. <br />removal of kitchen facility in second floor and basement apartments and any other strucniral <br />modifications that would deter use of either the basement or second floor as a residential unit. <br />OR <br />If approved, the following conditions should be considered in your approval. <br />1, All pertinent standards set forth under non-conforming use sections of the code listed <br />under Section 10.03, Subd. 5. <br />Removal of kitchen within basement. <br />Disclaimer that basement area could never serve for legal bedroom use <br />Legal abandonment of well through appropriate permits via State Health Department. <br />Applicant to obtain permit from City to make necessary alterations to fireplace in second <br />floor apartment maintaining clearance. <br />6. The property must be sold and retained for owner occupied use only. <br />7. Second floor apartment may never be e.xpanded by a structural addition to residence. <br />8. Applicant to assume responsibility to see that appropriate contractors file for the <br />necessary permits for recent improvements specified in inspector s notice. <br />9. Adequate off-street parking to be provided for two residential units. How many spaces? <br />10.
