Zoning File #1860 <br />October 7, 1993 <br />Page 3 <br />Please review the enclosed staff memo dated September 16th prepared for the Planmng <br />Commission's review providing background on the ordinances, history of the property, building <br />violations and special conditions for control of conditional use permit. <br />Planning Commission Recommendation <br />The Planning Commission recommended approval of the conditional use permit subject <br />to the controls outlined in the staff memo. Approval was based on the findings that the <br />operation of the use would be consistent with the surrounding single family residential <br />neighborhood. The use would not have a detrimental affect on the public health, safety or <br />welfare nor should that use diminish the property values of adjacent properties or improvements <br />in the vicinity. <br />The minority opinion of o.ne felt that clearly tliis was the time for the property to revert <br />back to a single family use finding that the property did not meet current zoning standards and <br />that property was incapable of supporting a duplex use. <br />Options of Action <br />1.To adopt the Planning Commission recommendation of approval and to add any <br />other conditions of approval deemed necessaiy by Council. As this u.se can only <br />be compatible with surrounding single family neighborhood if governed by <br />adequate controls, stiff would recommend that a resolution of approval be drafted <br />similar to the one developed by the City Attorney for Smith Bay Marina for the <br />property located at 1960 Shoreline Drive approving a boat sale/nautical shop at <br />the residential property. Staff has enclosed the resolution that includes the <br />exhibits consisting of approved site plan, consent of applicant and pertinent <br />ordinances (nonconforming use sections and standards for operation under a <br />conditional u.se permit); or <br />Denial; finding the proposed use to be in complete conflict with the necessary <br />findings approving a conditional use permit and that the duplex use would be in <br />complete conflict with the intent of the LR-IC Zoning District for single family <br />residential use. <br />Council Action <br />To provide staff with conceptual direction so that appropriate resolution can be drafted <br />per Council's review and action at their October 25, 1993. <br />ch
