The City Council finds that the conditions existing on this propeny are peculiar <br />to it and do not apply generally to other property in this zoning district; that <br />granting the variance would not adversely affect traffic conditions, light, air nor <br />pose a fire hazard or other danger to neighboring propeny; would not merely <br />serve as a convenience to the applicants, but is necessary to alleviate a <br />demonstrable hardship or difficulty; is necessary to preserve a substantial property <br />right of the applicants; and would be in keeping with the spirit and intent of the <br />Zoning Code and Comprehensive Plan of the City. <br />CONCLUSIONS, ORi)ER AND CONDITIONS <br />Based upon the above findings, the Orono City Council hereby grants after-the- <br />fact variances to Municipal Zoning Code Sections 10.22. Subdivision 2 and 10.56, Subdivision <br />16 (L) to allow 33.2% hardcover in the 250-500’ zone where only 30% hardcover is normally <br />allowed, and an after-tlie-fact variance to Section 10.24, Subdivision 5 (B) to allow a side yard <br />deck setlwck of 2’ where a 10’ side yard setback is normally required, subject to the following <br />conditions: <br />1 Hardcover on the property is limited to 33.2% of the lot area as shown on the <br />sketch on page 6 of this resolution. Hardcover removals required to bring the <br />property into compliance with this requirement are indicated on said sketch, and <br />such removals shall be completed within thirty days of the date of this resolution. <br />1 he property owners and all future property owners are advised that this property <br />is at its hardcover limit, and any future proposals to add or revise hardcover on <br />the property will require City approval, and might be approved only in <br />conjunction with concurrent removals of existing hardcover resulting in no net <br />increa.se of hardcover on the property. <br />The storage shed located in the front yard shall be removed from the property <br />upon applicants’ sale of the property but in any case shall be removed no later <br />than June 1. as agreed to by the applicant.s. <br />Applicants sliall »>btain an after-the-fact building permit (double permit fee) and <br />shall pay the $175 (X) after the fact investigation fee for this variance application. <br />Rage 3 of 7
