r <br />secnoMS 9s. •• <br />SECTION 10.56. SnOREIAND MANAGEMENT <br />Subd. 3. Definitions. Unless specifically defined <br />below, words or phrases used in this section shall be interpreted <br />as defined elsewhere in this chapter. All other words or phrases <br />shall be interpreted so as to give them the same meaning as they <br />have in common usage and so as tc give this ordinance its most <br />reasonable application. For the purpose of this section, the words <br />"must" and "shall" are mandatory and not permissive. All <br />distances, unless otherwise specified, shall be measured <br />horizontally. <br />13. "Intensive Vegetation Clearing" - The complete <br />removal of trees or shrubs in a contiguous patch, strip, row, or <br />block. <br />Subd. 16. Shoreland Overlay District Standards. The <br />Shoreland Overlay District Standards are in addition to the <br />requirements set forth in Chapter 10 for the various zoning <br />districts. In case of conflict, the most restrictive provision <br />applies. -------- <br />I. Vegetation Alterations. <br />1. No live tree within 75 feet of the <br />shoreline with a diameter of 6 inches or more (or 19 inches in <br />circumference or greater) measured 3 feet above the ground may be <br />removed without first obtaining a permit from the City staff <br />provided that at least the equivalent nuziber of replacement trees <br />of a size and nature found acceptable to the staff are planted at <br />the same setback from the shoreline as those removed. Appeals of <br />staff determinations as to type, size and quality of the trees to <br />be replaced will be to the Council. Removal of trees that are dead <br />shall not require a permit but such trees must be inspected by <br />City staff prior to their removal. ___ <br />2. Intensive vegetation clearing within 75 <br />feet of the shoreline and on steep slopes within the Shoreland <br />Overlay District is prohibited. Limited clearing of shrubs and <br />trees less than 6 inches in diameter and cutting, pruning and <br />trimming of trees of any size is allowed to provide a view to the <br />water from the principal dwelling site and to accomodate the <br />placement of permitted stairways and landings, picnic areas, access <br />paths, beach and watercraft access areas, and permitted lock boxes, <br />provided that the screening of structures, vehicles or other <br />as viewed from the water, assuming summer, leaf^on <br />conditions, is not substantially reduced. <br />SEC. 10.22. REGULATIONS FOR "LR-IA", "LR-lA-l", "LR-IB", <br />■ *LR~1C~1" ONE FAMILY LAKESOORE RESIDENTIAL DISTRICT. <br />Within any "LR-lA", "LR-lA-1", "LR-IB", "LR-IC", or "LR-lC-1" One <br />Family Lakeshore Residential District the following regulations <br />shall apply: <br />Subd. 3. Tree Removal Regulations. No live tree within <br />75 feet of the shoreline with a diameter ot six (6) inches or more <br />sh» be removed without first obtaining a permit from the City. <br />Sue;, permits shall be issued by the City staff provided that at <br />least a like number of replacement trees of a size and nature found <br />acceptable to the staff are planted, any question involving the <br />number of trees to be replaced will require approval. <br />Source: Ordinance 26, 2nd Series <br />Adopted: 7-14-86 <br />1..
