Mabusth <br />Building & Zoning Administrator <br />City of Orono <br />PO Box 66 <br />Crystal Bay, Minnesota 55323-0066 <br />RE: Request For Easement Vacation And Creation <br />OUTLOT F, SUGAR WOODS <br />Dear Ms. Mabusth: <br />With this application, Sidney and Barbara Rebers, owners of OUTLOT F, <br />SUGAR WOODS, hereby petition for vacation of a portion of a Drainage and <br />Utility Easement within their property and also request that new easements <br />be created to replace the one being vacated. <br />To provide some background information for this request, in 1989 the owners <br />platted and developed the northerly portion of their property into single <br />family homesites. The sanitary sewer system serving this development <br />commenced at a lift station located adjacent to the north right-of-way line <br />of Highway 12 approxim.ately 250 feet west of Brown Road. The sanitary <br />sewer system was desigr»xl to commence at the lift station and run generally <br />northeasterly to the southeast corner of single family development and from <br />there run along the west side of Brown Road until entering the <br />"neighborhood". <br />When the proposed route v^as laid out it was fou*id to run through a mature <br />forested area and that its installation would destroy a large number of the <br />trees. At that time it was decided, in order to minimize the impact on the <br />vegetation, that the sewer ’“'ould be realigned to run within the easement area <br />in which the storm water pond was to be built. See the attached copies of <br />Sheet 8 of the construction plans for the as-built location of the sanitary <br />sewer line. <br />It is necessary to both vacate the easement area where the sewer was initially <br />intended to go and in turn create a replacement easem«it for the sewer line.
