A RESOLUTION VACATING <br />A DRAINAGE AND UTILITY EASEMENT <br />WITHIN THE PLAT OF S»^»AR WOODS, <br />SECTION 34. TOWNSHIP 118 RANGE 23 <br />IN THE CITY OF ORONO, MINNESOTA <br />FILE NO. 1869 <br />WHEREAS, the City of Orono is a municipa. corporation organized and existing <br />under the la\/s of the State of Minnesota; and <br />WHEREAS, on August 27, 1993, Sidney and Barbara Rebers filed a petition with <br />the City of Orono requesting the vacation of a drainage and utility easemc it originally dedicated <br />in the plat of Sugar Woods, legally described as follows: <br />All that part of the 30’ wide drainage and utility easement in Outlot F, Sugar Woods, <br />according to the plat thereof on file and of record in the office of the Registrar of Title, <br />Hennepin County, Minnesota, lying northerly of a line drawn parallel and concentric <br />with and distant 30’ northerly from the southerly line of sakl Outlot F; and <br />WHEREAS, after due published and posted notice, a public hearing was held <br />before the City Planning Commission on September 20, 1993, regarding said vacation and all <br />interested persons were given an opportunity to be heard; aiKl <br />WHEREAS, aPer due standing and consideration, the Planning Commission <br />recommend approval of die proposed vacation and the Council of the City of Orono finds that <br />sa ’d vacation as proposed ir. in keeping with the public interest and in consideration of the <br />tollowing findings: <br />1. The City does not intend to expand additivinai municipal sewer lines within the <br />30’ easement area. <br />2. The easeniem as it exists serves no public purpose. <br />Pace 1 of 2
