5. <br />6. <br />Creation ot Outlet A that is not contiguous with Lots 1 and 2 and is divided from <br />the remainder of the property by a County road. Said lot shall be designated as <br />an unbuildable lot and available for combination with adjacent residential <br />properties on nonh side of County Road 84 or Bayside Road. <br />Payment to the City of a Park Dedication Fee in the amount of $2,5 ‘W.OO. <br />Payment to the City for the legal review and filing of the plat, and other <br />documents in the amount of $150.00. <br />7. Payment to the City for the final plat application fee at $150.00. <br />NOW, THEREFORE BE IT RESOLVED, that the City Council of the City of Orono <br />hereby approves the plat of Johnson Wheeler 1st Addition, Hennepin County. Minnesota, subject <br />to the following condition'. <br />1. Access to Lot 1 shall remain via an existing driveway that serves the existing <br />residence. <br />• <br />3. <br />4. <br />Access to Lot 2 shall be achieved via an existing private drive along the cast side <br />of the property owned by the applicant. Upon the sale of Lot 2, applicant shall <br />grant an access easement in favor of Lot 2. Such access must be located at the <br />extreme southeast comer and to extend no further north than 25 ’ in order to <br />maintain a 20’ separation setback from the principal drainficld site. <br />The 30.4 ’ x 18.4’ bam on Lot 2 shall be removed by October 11, 1994 if a <br />building pcmiit has not been issued for residential constaiction by that date. <br />The aforesaid plat shall be filed by the City of Orono with either the Hennepin <br />County Reci>rder ’s Office or Registrar of Titles Office on or before April 11, <br />1094 together w ith a certified origiiul copy of this resolution and executed copies <br />of either easements or covenants noted above. <br />I’age 2 of 3
