CONCLUSIONS, ORDER AND CONDITIONS Based upon one or more of the findings noted above, the Orono City Council hereby grants variances to Municipal 2^ning Code Section 10.03, Subdivision 9 (D), Section 10.25, Subdivision 6 (B) and Section 10.22, Subdivision 2 to permit additions to the existing accessory structure requiring an 8’ or 80% setback variance for the garage addition and a 13’ or 43% setback variance for the srorage addition and hardcover variances in the 75-250 ’ setback area proposed nt 5,068 s.f. or 36.8%, subject to the following conditions: 1 . Applicant shall complete certain grading improvements within the street rear yard in order to minimize erosion and eliminate flooding of lower basement at the time of the new construction. 2. 3. 4. 5. All hardcover removals are shown on Page 6 of this resolution shall be completed prior to the footing inspection for new construction. Authorities granted by this variance run with the property not with the applicant, but are permissive only and must be exercised by application for a building permit within one year of the date of Council approval, or this variance will expire on that date (October 11, 1994). Violation of or non-compliance with any of the terms and conditions of this resolution shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor.
