Zoning Files ^1866, #1867, #1868 <br />September 15, 1993 <br />Page 3 <br />meets the standards set forth in the Shoreland Regulations proposed at a 4’ width with landings <br />not exceeding 32. s.f. <br />The applicant claims the deck strucnire is needed to support an irrigation iiiucture. <br />Based on the detail plan, the structure appears to be 4’ x 4’ at a 4’ height. fiiVh' long stone <br />wall extends to the north side of the lakeside deck. Detail plans also reveal a l'/^" wide cedar <br />pillar with lantern at a total height of 6’. It is not clear from the plans where the pillar is to be <br />located. Applicants ’ representative should specify location of light post. Please note boathouse <br />attached to deck is not proposed. <br />Statement of Hardship <br />Refer to Exhibit K. <br />Issues for consideration <br />1. Applicants ’ hardship statement notes that boathouse and stone step structure will <br />be abandoned at some future date. Section 10.56, Subd. 16 (F) does not <br />specifically limit the number of access stairs to a property. The property consists <br />of approximately 620 ’ of lineal feet of shoreline and if subdivided into three lots <br />could legally hold three residential docks with access stairs. <br />2. What is your reconunendation concerning lakeside deck at either 114 s.f. or 70 <br />s.f.? Should the deck be limited to a specified area or dimension, i.e. 8’ x 4’ or <br />32-50 s.f.? <br />3. New shoreiand regulations do not address lighting for security purposes. The <br />only ordinance limitaticMis would be setbacks for structures on lakeshore. If light <br />was placed on diKk, LMCD rules would apply. <br />Application #1868 - Conditional I se Permit for Cucst House/Caretaker Apartment <br />Refer to Exhibit L. The City has received no floor plans of the residential units within <br />the structure nor ha.s the structure b«n available for inspection by staff. TKe areas of the guest <br />house and caretaker apartment have been designated on the survey. The struemre is also made <br />up of a greenhouse structure and lower level three-stall garage. The structure is located 58 <br />from the travelled 20 ’ wide public roadway and 3’ from the south side lot line. <br />The applicant was asked to file a conditioiul use permit to aUow the contimicd use of the <br />structure for non-rental residential use by either don^stic help or guests. It is suffs <br />understanding that the second fliwr caretaker apartment is currently occupied. Applicant has no <br />current plans to rcnuxkl structure
