B The lakeside deck will not be used for recreation or entertainment but will serve as a storage area for dock sections during winter months, house an irrigation structure and a 6’ light post for safety and security purposes. C.Entire property has over 1,600 lineal feet of shoreline. The east shoreline with 620 lineal feet has steep lakeshore banks requiring an access stairs. The City Council finds that the conditions existing on this property are peculiar to it ind do not apply generally to other property in this zoning district; that granting the variance would not adversely affect traffic conditions, light, air nor pose a fire hazard or other danger to neighboring property; would not merely serve as a convenience to the applicants, but is necessary to alleviate a demonstrable hardship or difficulty; is necessary to preserve a substantial property right of the applicant; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. The City Council has considered this application including the fuidings and recommendations of the Planning Commission reports by City staff, comments by the applicants and the effect of the proposed variance on the health, safety and welfare of the community. CONCLUSIONS, ORDER AND CONDITIONS Based upon one or more of the above findings, the Orono City Council htrchy grants variances to Municipal Zoning Code Section 10.22, Subdivisions i (B) and 2 to permit construction of an access stair and lakeside deck resulting in 966.5 s.f. or .74% hai^over in the 0-75’ setback area and the deck that will be located 2 ’ from the shoreline, subject to the following conditions: Page 2 of 5 L
