The heme at that time <br />contained rental units. Rental use has continued to the present. Basement unit is not occupied, <br />but the second floor rental unit is currently occupied by two people. Mrs. McKinney has been <br />advised that if she is to sell her home as a duplex, she must seek to make that use legal, via a <br />Conditional Use Permit. She has been asked to provide evidence that the use existed back to <br />1962 and that the use continued through the years without a lapse in time. <br />The applicant has provided income tax record and original handwritten rent receipt <br />records for the years not covered by the tax recoid to confirm that property has been a rental <br />property through her ownership.* Review Exhibit E. A building permit was issued in 1957 and <br />the City noted the following on the permit; 'This house is being used tor multiple dwelling. <br />Review Exhibit F'. as late as 1978. the City was approsing building permits for improvements <br />to the apartments. <br />The structure is currently divided off into three separate apartments. The lower level <br />basement 'valkout cannot support a bedroom per current Code. Applicant is not prop<ising a <br />triplex but seeks approval of a duplex.
