Zoning File #1077 <br />October 9, 1986 <br />Additional Comments and Planning Commission Recommendation: <br />Additional List of Exhibits <br />Exhibit I - Kilbo Memo <br />Exhibit J - Lynch Report Dated 9/11/86 <br />The Planning Commission voted unanimously to recommend approval <br />of Mrs. Cici's variance to the Limited Development Ordinance per the <br />staff recommendation on page two of this memo. <br />Staff had originally planned to present the Cici project in a <br />comprehensive review covering both the moratorium variance and <br />conditional use permit/commercial site plan for the nursery school but <br />the applicant has asked to address the Council on matters surrounding <br />the access recommended by the reviewing staff. <br />ff Council reviews the minutes of the September 15th Planning <br />Commission meeting, access was clearly the major concern. Access to <br />the site had to be deemed safe before the Commission could make the <br />necessary finding that the public welfare would be safeguarded with <br />the development of this property. <br />The problem for the applicant is the realization that all <br />construction costs for this new access road must be borne by the <br />developer - this, of course, includes the left turn lane within the <br />right-of-way of Highway 12 estimated by the Highway Department would <br />be at a cost of approximately $30,000. <br />The applicant and current owner of the property claim that such <br />costs make the site impossible to develop and seek relief from the <br />City. Staff has advised both applicant and owner that the City has <br />never participated in the financing of road .improvements benefitting <br />private development. <br />Staff would suggest that road construction costs could be <br />absorbed by additional uses of the property. The property consists of <br />6+ acres of dry buildable contiguous lands and provides a potential <br />for 2 additional use units if planned carefully - note the majority of <br />the road appears to be located in the defined wet areas along the east <br />borders. <br />Council Action: <br />To give conceptual direction to staff to prepare a comprehensive <br />approval resolution for both the variance to the Limited Development <br />Ordinance and the conditional use permit/commercial site plan <br />application for the day care use at the time the later application is <br />ready for Council action. <br />5
