t ■ i <br />V <br />f <br />P <br />AGREEMENT <br />AGREEMENT (the "Agreement”) made the 6th day of June, 1986 by <br />and between John and Linda Massopust ("Massopusts") and Longridge <br />Associates, a Minnesota General Partnership ("Longridge"). <br />RECITALS: <br />Massopusts own a parcel of property located at 440 South <br />Brown Road, Orono, Minnesota (the "Property"). <br />The Property is adjacent to land owned by Longridge (the <br />"Longridge Property"). <br />There is a pond on the Property which extends onto the <br />Longridge Property. <br />Massopusts desire to upgrade the pond, at their expense, <br />require that Longridge join in applying for City of Orono <br />permission in order to do so. <br />and <br />Massopusts represent that this is the only permission <br />required and Longridge is agreeable to joining in applying for <br />such permission. <br />AGREEMENT: <br />1. Longridge will sign with Massopusts, the General Land Use <br />Application which the Massopusts will present to the City of Orono <br />seeking permission to upgrade the pond. <br />2. Massopusts will do all necessary and pay all costs and <br />expenses associated with the application and the work of upgrading <br />the pond. <br />3. The work is to commence promptly*upon receiving the City <br />of Orono permission and continue to prompt conclusion (estimated <br />to be accomplished within three weeks of commencing). <br />4. The work is to be accomplished with reasonably minimal <br />intrusion upon the Longridge property and in a manner that will <br />preserve the natural setting. <br />5. Massopusts agree to indemnify Longridge and its partners <br />against all expense liability or loss that they or any of them may <br />sustain arising out of this upgrading of the pond project. <br />LONGRIDGE ASSOCIATES, a <br />Minnesota General Partnership <br />--/r//LtLLy. // <br />^ohn E.
