I
i
To:Mayor Butler
Mark E. Bernhardson, City Administrator
Orono Council Members
Orono Planning Commission Members
Pn Michael P. Gaffron,
Assistant Planning & Zoning AdministraUr-:
Date:September 10r 1986
Subject: #1072 Fred Winston# 765 Spring Hill Road
Variance - Public Hearing
Zoning District - LR-lA, 2-acre
Application - Variance to 150' horse barn setback requirement
List of Exhibits
Exhibit A
Exhibit B
Exhibit C
Exhibit D
Exhibit E
Exhibit P
Application
Plat Map
Property Owners List
Barn Plan
Site Plan
Survey
Pertinent Facts:
- Required horse barn property line setback *= 150*
- Existing horse barn property line setback « 35.73'
- Proposed addition to existing barn is 50'+/- from property line
- Existing barn with proposed additions is about 500' from any off-site
residences
- Barn will be about 160' from wetlands
- Dry area of parcel is about 11 acres
Applicant also owns parcel to the south which contains about 12 dry
acres
Discussion:
Applicant is currently acquiring this parcel on which he requests a
lot-line setback variance to construct an addition to the existing horse
barn. The total dry acreage controlled by Mr. Winston is about 23 acres,
so he could have as many as 21 horses on the site. This barn does not
appear to be large enough for more than perhaps 1/3 that number.
The nearest off-site residence is 500' to the east, owned by Mr.
Wildman. No comments have been received from him as of this writing. Mr.
George Partridge's residence is about 500' north of the barn, and he also
has not commented to date.
Staff Recommendation:
Given that this barn is 500'-plus from any off-site residence
structures, and given that the addition will be on the side of the existing
strucutres away from the lot line, staff recommends approval subject to
applicant submitting a letter of non-objection from the affected neigh
boring property owner, Mr. Wildman.
-
