This would <br />fall under the "Temporary Two-Family Housing" Code Section 10.08, <br />Subdivision 3 (A)7. Because this is a variance, the City can <br />place whatever conditions are necessary on any approval, in order <br />to ensure that single family residences do not become duplexes. <br />Note that the proposed layout does not meet the criteria for a <br />main access entryway within the principal dwelling, which the <br />Council has generally held to in similar applications. This <br />should be an item for discussion. <br />Staff Reccxnmendtion: <br />Staff would recommend approval of temporary "two-family <br />dwelling" status for the Nelson residence under the following <br />conditions: <br />1. The second dwelling unit is allowed as a guest apartment <br />only, to be used only for relatives and non-paying guests of <br />the current property owners. The unit may not be rented <br />out. <br />2. The two-family dwelling or guest-apartment use shall <br />cease at such time the applicants no longer own the <br />property. Any subsequent property owner must re-apply for a <br />two-dwelling unit use. <br />Note that staff expects to bring forth a proposed code <br />amendment in October creating copropriate standards for this type <br />of guest apartment.
