Access is gained through the main house stairway and walkout <br />level doors, as well as an indirect access to garage. The intent is for <br />Mr. Martineau's mother to move in with them in a year or two. <br />This application is nearly identical to a recent application on Luce <br />Line Ridge for a similar basement apartment. Again, the house is designed <br />essentially as a one-family residence in a one-family zone, and will fit in <br />with the character of the neighborhood. <br />Staff Recoomendation: <br />Staff recommends approval of a "temporary two-family dwelling" status <br />variance for the Martineaus, per Code Section 10.08, Subdivision 3 (A)7, <br />with the following findings and conditions: <br />FINDINGS <br />1. The applicants intend the apartment to be used as a guest apartment <br />only and have no intent to rent the apartment. <br />2. The apartment, as designed, is on the walkout level of the house and <br />may be accessed from within the main house as well as from direct exit to <br />the rear yard at the walkout level, or indirectly to the garage. <br />CONDITIONS <br />1. The main entrance to the house shall remain as an open foyer, forcing <br />the apartment occupant to enter the apartment from within the main house, <br />as shown on the proposed design plans. <br />2. This use variance is granted on a temporary basis and shall expire at <br />such time that the applicants no longer own the property. Any new owner <br />would have to reapply for the guest apartment use. The temporary variance <br />is not transferable to a new owner without Council approval. <br />3. The mother-in-law apartment shall not be rented out and is intended fnr <br />the sole use of the applicants while they are occupants of the principal <br />residence and their non-paying guests or domestic employees. <br />i
