Item No.: 4.3 Date: January 16, 2024 <br />Presenter: Natalie Nye <br />Presenter: Planner <br />Section:Public Hearings <br /> <br /> <br />Title: LA23-000065, Eskuche Design, 4423 North Shore Drive, Variances <br /> <br /> <br />1.Purpose: <br />The review of an application for an average lakeshore setback variance and bluff setback variances <br />for the construction of a new home. <br />2.MN§15.99 Application Deadline: <br />This application was received on December 13, 2023 and considered to be complete on December <br />26, 2023. Therefore the 60-day application review deadline is February 24, 2024. <br />3.Background: <br />The applicant is proposing to demolish the existing home and construct a new home in a similar <br />location. The subject property is a lake lot with bluffs present along the southern and western <br />property line. The existing home encroaches into the average lakeshore setback and into the bluff <br />impact zone and bluff setback. The proposed home requires variances from average lakeshore <br />setback and from bluff setbacks in order to be built in a similar location. <br /> <br />Due to the sensitivity of the bluff, Staff does not support the application as applied. The <br />applicant’s choice of home design, location, and amenities lead to further encroachments within <br />the bluff setback and bluff impact zone and are out of convenience for the chosen home design. <br />The staff report attached as Exhibit A contains a full background and detailed analysis. <br />4.Staff Recommendation: <br />Planning Staff recommends denial of the application as applied due to the sensitivity of the bluff. <br />Staff is supportive of the average lakeshore setback variance and the need of a driveway within the <br />bluff setback.
