ORDINANCE NO. 284, THIRD SERIES <br />CITY OF ORONO <br />HENNEPIN COUNTY,MINNESOTA <br />AN ORDINANCE AMENDING THE CODE OF ORDINANCES <br />PERTAINING TO RETAINING WALLS <br />THE CITY COUNCIL OF ORONO ORDAINS: <br />SECTION 1. Chapter 78, Section 1, Definitions shall be amended by removing the <br />strikethrough text and adding the underlined text: <br />Retaining wall means a wall or similar structure designed and constructed to hold back and <br />prevent lateral movement of earth or other landscaping materials. Two or more abutting boulders, <br />24 inches in diameter or greater, placed to hold back the earth are considered to be a retaining <br />wall. Landscape edging, less than 6 inches tall, is not considered a retaining wall. <br />SECTION 2. Chapter 78, Section 566. Accessory Uses. shall be amended by removing <br />the strikethrough text and adding the underlined text: <br />within 75 feet of the shoreline. <br />4-413)Home occupations, as defined in this chapter. All home occupations shall comply with <br />the provisions of section 78-1376, and the licensing provisions of section 26-76, when <br />applicable. <br />4414)New boathouses within 75 feet of the shoreline are specifically prohibited. <br />SECTION 3. Chapter 78, Section 1279. Placement of buildings and structures on <br />lots shall be amended by removing the strikethrough text and adding the underlined text: <br />5) Fences, docks, retaining walls. No fence shall be placed within the Shore Setback zone. <br />Portions of dock located landward of the OHWL shall be considered as a landing, <br />subject to the regulations for landings per section 78-1282. Retaining walls shall not be <br />placed within the Shore Setback zone. within the Shore Setback zone may be permitted <br />according to the following: <br />a) A retaining wall may be constructed within the shore setback zone if it is an <br />integral part of a permitted lake access stair and the retaining wall is designed to <br />be the minimum size necessary. <br />b) A replacement retaining wall, including a change in material, may be permitted <br />within the shore setback zone when all of the following conditions are met: <br />1.
