Steep sloping topography adjacent to house requires retaining <br />walls, flat area for safe utilization of pool and rear yard and need <br />for access steps to lakeshore. <br />2. The adjacent yards do not have steep slopes as these found in the <br />applicant's lakeshore yard. <br />3. The improvements create no viev/ barrier nor do they pose hazards <br />for neighboring properties. <br />4. The proposed improvements are similar to the types of improvements <br />found in the same Carman Road neighborhood where lakeshore yards have <br />severe slopes to lake (lots on main lake). <br />5. The improvement does not alter the character of thr neighborhood. <br />6. The decking is an acceptable conforming use within a residential <br />district. <br />7. The proposed improvements will have a positive effect on the <br />surrounding property value. <br />Staff's inventory of recent applications that involved approval of <br />structures and hardcover within the 0-75' setback area: <br />#1033 Dossett, 2795 Pheasant Rd. - approved 100 s.f. or 1% of <br />structural hardcover and 280 s.f. or 3% of innovative grade decking <br />based on location of house to 75 feet setback and no visual impact on <br />lake. <br />#1006 Palm, 1710 Shadywood Rd. - approved additional structure in <br />place ol existing patio hardcover, not to be any closer to the lake <br />than existing hardcover. 0-75' hardcover 17.5%. <br />#983 Pemberton, 3580 North Shore Pri/e - approved new structure and <br />hardcover in 0-75' zone. 0-75' hardcover 20%. <br />#943 Purdy, 1975 Fagerness Point Rd. - approved additional 72 s.f. of <br />structural hardcover with concurrent major removals of other 0-75' <br />hardcover (reduction from 24.3% to 13.9%). <br />#932 Edwards, 2474 Carman Street - approved variances for a new <br />residence to be constructed partially within the 0-75' setback area <br />based on 1) surface drainage naturaJly graded away from the lake, and <br />2) lakeshore at both front and rear of property so that neighbors <br />requested that location of new house conform to the existing houses <br />for view purposes. 0-75' hardcover 15.8%. <br />4 <br />i
